WICASSET, Maine (AP)   A marriage annulment hearing for a Maine mother charged with beating her 10-year-old daughter to death with her husband’s help has been postponed.

Sharon Carrillo’s lawyer, Christopher MacLean, says Julio Carrillo failed to show up to the hearing scheduled Thursday afternoon.

MacLean says he planned to show evidence that Julio Carrillo wasn’t legally divorced from Kathleen Carrillo, of Louisville, Kentucky, at the time he married Sharon.

Both Sharon and Julio Carrillo have pleaded not guilty to charges of depraved indifference murder of Marissa Kennedy.

Investigators previously said the Carrillos acknowledged taking turns beating the girl before her death in February at their Stockton Springs condominium.

MacLean has said that Julio Carrillo was abusive and controlling toward Sharon Carrillo.

A makeup date for the annulment hearing has yet to be scheduled.
