Three family members accused of abusing and killing a 10-year-old Bangor boy have been indicted.

According to the Bangor Daily News, Braxtyn Smith was down to 48 pounds and was bruised and burned when he died in the hospital in February. His parents, Joshua Smith and Jem Bean, as well as his grandmother, Mistie Latourette, were all charged with depraved indifference murder.

According to court documents, the boy’s parents tied him up to restrain him because he was being defiant, and left him restrained even when sleeping or using the bathroom.

Prosecutors say there were multiple other instances of abuse in the home, including hits to Braxtyn’s head and withholding food from him as punishment. A fourth person who lived in the home said the boy slept on the floor and ate dog food.

His parents and grandmother are due back in court on May 28.
