PORTLAND, Maine (WGAN) A mistrial has been declared in the case of a Windham man accused of killing his wife.
Noah Gaston was charged with intentional or knowing murder and manslaughter in the death of his wife, 34-year-old Alicia Gaston, in January of 2016. He says he mistook her for an intruder when he fired the fatal shot that night. The couple’s three children were in the home at the time.
According to the Bangor Daily News, the mistrial was granted on Thursday. The state’s chief medical examiner had told the prosecutor he had changed his opinion about the trajectory of the shotgun pellets fired from the weapon.
The trial was paused without explanation on Tuesday as the judge met with attorneys behind closed doors.
