Justices Decline to Remove Prosecutors from Murder Trial

AUGUSTA, Maine (AP)   Maine’s supreme court has declined to remove prosecutors handling the case of a mother accused of beating her 10-year-old daughter to death with her husband’s help.

Defense attorney Chris MacLean contended prosecutors inappropriately obtained records relating to defendant Sharon Carrillo’s mental health state.

The attorney general’s office filed a subpoena with a school in New York and threatened a made-up court date if the records weren’t produced. The attorney general’s office said the error was just a mix-up caused by a miscommunication among prosecutors.

The supreme court dismissed an appeal by Carrillo’s attorney on Tuesday.

Sharon and her husband, Julio Carrillo, have pleaded not guilty in the death of her daughter, Marissa Kennedy, in Stockton Springs. Investigators said they acknowledged taking turns beating the girl before her death in February.
