Maine environmental agencies face lawsuit over Kennebec River dam controversy

Dams along Maine’s Kennebec River are the subject of a lawsuit being filed against the state.

The Canadian-based Brookfield Renewable Power has sued the Maine Department of Environmental Protection and Department of Marine Resources.

According to the Portland Press Herald, the suit filed on Monday claims the agencies would violate a legally binding agreement from 1993 and other state laws if they demolish four dams located between Waterville and Skowhegan.

Conservationists, along with the administration of Governor Janet Mills which is aiming to remove at least one of the dams, say they pose a problem for Atlantic salmon by preventing them from getting to a spawning habitat.

Brookfield argues that those concerns can be addressed by building or improving fish passages instead of removing the dams.
