A 41-year-old Maine man is accused of killing another man before being shot by police in Portland Monday night.

Police say they were sent to the scene at 27 Colonial Road at 8:27 pm, where a tenant was able to escort them into the residence. Officers say the tenant entered the apartment in front of them, and then ran back towards them screaming.

Officers say they proceeded into the residence where they found an active incident in which Brian Oliver of Portland was assaulting another man, identified as 69-year-old Mark Tschamler, who died at the scene.

Police say Oliver did not comply with commands to drop his weapon and was shot.

Oliver is being treated at Maine Medical Center in Portland and will be charged with murder.

Two officers, Joseph Lowe and David Moore, are on administrative leave after shooting Oliver, which is standard practice when officers are involved in a deadly force incident.

The state Attorney General will be investigating the officers’ use of deadly force.
