BANGOR, Maine (AP) A state judge has ended a lawsuit that alleged Maine was failing to comply with a law to restore the public health nursing program.

The Bangor Daily News reports Friday that Superior Court Judge Michaela Murphy has found that the state Department of Health and Human Services is now “substantially complying” with the 2017 law.

The agency’s spokeswoman says the state has now filled 38 of 53 positions in the public health nursing program.

The administration under the former Republican governor has largely dismantled the program.

A Democratic state senator and two nurses sued when the state missed a deadline to bring the program back to full staffing.

The judge also rejected the state’s arguments that the court had no role to play in overseeing a state agency’s hiring practices.
