PORTLAND, Maine (AP) Attorneys for a New York man convicted of killing a Maine couple on Christmas Day 2015 have requested a new trial.

The Kennebec Journal reports David Marble was granted a hearing request for 10 a.m. Friday in Cumberland County Superior Court. A judge had originally scheduled sentencing on the date.

Marble’s attorneys claim the judge should’ve suppressed information about the location of their client’s cellphone during the murder trial. They also say there was no forensic evidence including DNA or fingerprints tying Marble to the shootings.

The state has requested the motion be dismissed.

Prosecutors say David Marble shot 35-year-old Eric Williams and 26-year-old Bonnie Royer in the head at close range because he thought Williams had stolen from him. The killings happened in Manchester, outside the state capital city.
