PORTLAND, Maine (WGAN) A second murder trial got underway Wednesday morning for Noah Gaston, who’s accused of murder in his wife’s death.

The 37-year-old is charged with murder and manslaughter in the death of his wife Alicia Gaston. He says he mistook her for an intruder when she entered their Windham home in the early morning hours of January 14th, 2016. Prosecutors say evidence contradicts his story.

A judge declared a mistrial back in February when the medical examiner changed his opinion about the angle of the gunshot wound, calling into question how far away Alica was when she was shot.
